Terms of Service for Insectr

These Terms of Service ("Terms") govern your use of Insectr, a mobile application provided by Daily Labs, LLC ("Daily Labs," "we," "us," or "our"). By using Insectr (the "App"), you agree to these Terms.

1. What the App Does

Insectr allows you to submit photos of insects and similar small creatures, receive AI-assisted identification results and educational information, and save identification history locally on your device.

2. Eligibility and Acceptable Use

You agree to use the App only in compliance with applicable law. You may not:

• Use the App for unlawful, abusive, or fraudulent purposes.
• Attempt to interfere with, disrupt, or gain unauthorized access to the App or related systems.
• Submit content that you do not have the right to use.
• Use the App in a way that could harm Daily Labs, its service providers, or other users.

3. AI-Generated Results

Insectr uses AI and third-party processing services to generate likely identifications and related information. Results are provided for general informational and educational purposes only.

We do not guarantee that any identification, safety information, or related content is accurate, complete, or suitable for any specific purpose. For stinging, biting, venomous, medically significant, or otherwise risky species, you should consult a qualified expert or other trusted source before acting on the result.

4. Your Content

You retain ownership of the photos you submit. By using the App, you authorize us and our service providers to process submitted images as needed to operate the identification service.

You are responsible for the content you submit and for ensuring that you have any rights or permissions necessary to use it.

5. Storage and Availability

Saved images and identification history are primarily stored locally on your device. We may change, suspend, or discontinue some or all of the App at any time, including feature availability, without liability to you.

6. Intellectual Property

The App, including its software, branding, design, and related materials, is owned by Daily Labs or its licensors and is protected by applicable intellectual property laws. Except for the limited right to use the App under these Terms, no rights are granted to you.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

8. Limitation of Liability

To the maximum extent permitted by law, Daily Labs and its affiliates, officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, profits, or business interruption arising out of or related to your use of the App.

To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the amount you paid, if any, to use the App in the twelve months before the claim arose.

9. Termination

We may suspend or terminate your access to the App if you violate these Terms or if we reasonably believe your use creates risk or harm.

10. Changes to These Terms

We may update these Terms from time to time. If we do, we will post the updated version on this page and revise the effective date above. Your continued use of the App after the updated Terms take effect means you accept the revised Terms.
